Please read these Terms and Conditions carefully before using ChessForgePro.

Interpretation and Definitions

Interpretation

The words whose initial letters are capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

Definitions

For the purposes of these Terms and Conditions:

• Account means a unique account created for You to access the Service or parts of the Service.

• Company referred to as "We", "Us" or "Our" means ChessForgePro, an early-stage independent software project operated from Ukraine.

• Device means any device that can access the Service, such as a computer, mobile phone, tablet, or similar device.

• Service means the ChessForgePro website and related chess training, analysis, repertoire, puzzle, account, and waitlist features accessible at https://chessforge.pro.

• Terms means these Terms and Conditions.

• User Content means chess data, PGN files, games, moves, FEN positions, repertoires, analysis results, generated puzzles, training progress, preferences, comments, or other content that You import, upload, create, save, or process through the Service.

• Waitlist means a form, popup, modal, or similar feature that allows You to register interest in planned Pro, Premium, or other future features.

• You means the individual accessing or using the Service, or the legal entity on whose behalf such individual is accessing or using the Service.

Acknowledgment

These Terms govern Your access to and use of the Service and constitute a legally binding agreement between You and ChessForgePro.

By accessing or using the Service, creating an Account, importing chess data, joining a Waitlist, or otherwise using any feature of the Service, You agree to be bound by these Terms. If You do not agree with any part of these Terms, You must not use the Service.

Your use of the Service is also subject to Our Privacy Policy, which explains how We collect, use, store, and delete Personal Data. The Privacy Policy is incorporated into these Terms by reference.

Age Restriction: 18+ Only

The Service is intended only for individuals who are at least 18 years old.

By accessing or using the Service, You represent and warrant that You are at least 18 years of age. If You are under 18 years of age, You must not access, use, create an Account, submit information to, upload data to, or join a Waitlist through the Service.

You must not create an Account for, or submit Personal Data on behalf of, any individual under 18 years of age.

If We discover or reasonably believe that a user is under 18 years of age, We may suspend or terminate the Account and delete the Account and associated data from Our active systems as described in Our Privacy Policy.

User Accounts

To use certain features of the Service, You may need to create an Account. When You create an Account, You must provide accurate, current, and complete information.

You are responsible for maintaining the confidentiality of Your login credentials and for all activities that occur under Your Account.

You agree to notify Us promptly if You believe Your Account has been accessed without authorization or if Your login credentials have been compromised.

We reserve the right to suspend, restrict, or terminate Accounts that violate these Terms, create security risks, show signs of misuse, appear to be created by users under 18, or are otherwise used in a way that may harm the Service or other users.

User Content and Chess Data

The Service may allow You to import PGN files, connect chess accounts, create opening repertoires, generate puzzles, save training progress, and perform chess analysis.

You retain ownership of Your User Content, including Your games, PGN files, repertoires, analysis results, and training data.

By importing, uploading, creating, saving, or processing User Content through the Service, You grant Us a non-exclusive, worldwide, royalty-free license to store, process, analyze, reproduce, display to You, technically transform, and otherwise use such User Content solely as necessary to provide, maintain, secure, debug, and improve the Service.

We do not claim ownership of Your games, repertoires, PGN files, or analysis results.

We may use anonymized or aggregated data to understand usage patterns, improve features, debug issues, improve training tools, and maintain the Service, provided that We do not use such data to identify You.

You represent and warrant that You have the right to import, upload, use, and process any chess data You submit to the Service, including games from Lichess, Chess.com, PGN files, databases, or other sources.

You are responsible for ensuring that Your use of any third-party chess data complies with applicable laws, platform terms, database rights, tournament rules, and any other restrictions that may apply.

Acceptable Use

You agree not to:

• Use the Service for any illegal, harmful, fraudulent, abusive, or unauthorized purpose;
• Use the Service if You are under 18 years of age;
• Create an Account for another person without authorization;
• Upload malicious code, viruses, malware, or harmful content;
• Attempt to gain unauthorized access to the Service, accounts, servers, databases, APIs, or related systems;
• Use bots, scrapers, crawlers, automated tools, or bulk access methods without Our prior written permission;
• Bypass, disable, or interfere with any security, access control, rate limit, usage limit, or technical protection;
• Share, sell, rent, sublicense, or transfer access to Your Account or any restricted feature;
• Attempt to reverse engineer, decompile, disassemble, or copy any part of the Service, except where such restriction is prohibited by applicable law;
• Use the Service in a way that imposes an unreasonable or disproportionate load on Our infrastructure;
• Interfere with or disrupt the operation, security, integrity, availability, or performance of the Service;
• Use the Service to violate the rights of others, including intellectual property, privacy, or contractual rights;
• Misrepresent Your identity, affiliation, age, or authority to use any data submitted to the Service.

Fair Play

ChessForgePro is intended for chess training, study, analysis, preparation, and educational use.

You agree not to use the Service to cheat, gain an unfair advantage, or violate fair-play rules of any chess platform, tournament, club, federation, school, organizer, or other organization.

You must not use the Service, including engine evaluations, analysis tools, generated recommendations, repertoires, puzzles, or training features, during any ongoing game, match, tournament, event, or competition where outside assistance is prohibited.

You are responsible for understanding and following the fair-play rules, anti-cheating rules, and assistance restrictions that apply to You.

User Responsibility

You are responsible for how You use the Service, including any decisions You make based on analysis results, engine evaluations, recommendations, generated puzzles, imported chess data, or training suggestions.

Chess analysis may be incomplete, inaccurate, outdated, or unsuitable for Your specific chess goals. You should use Your own judgment when relying on any analysis, recommendation, or training feature.

You are responsible for ensuring that Your use of the Service complies with applicable laws, third-party platform rules, tournament regulations, club rules, school rules, employer policies, and any other obligations that may apply to You.

Intellectual Property

The Service, including its software, design, user interface, features, branding, logos, text, graphics, layout, workflows, databases, and other materials, excluding Your User Content, is owned by ChessForgePro or its licensors and is protected by applicable intellectual property laws.

These Terms do not grant You any ownership rights in the Service.

You may use the Service only as permitted by these Terms. You may not copy, modify, distribute, sell, lease, sublicense, publicly display, or create derivative works based on the Service unless We expressly authorize You to do so in writing.

Early-Stage Service, Beta Features, and Availability

ChessForgePro is an early-stage service. Some features may be free, experimental, incomplete, limited, unavailable, changed, delayed, suspended, or discontinued at any time.

We may modify, limit, suspend, or discontinue any part of the Service, including beta, experimental, planned, preview, or not-yet-implemented features, with or without notice.

We do not guarantee that any specific feature, integration, import method, analysis tool, training tool, puzzle feature, repertoire feature, or planned functionality will always be available or remain unchanged.

We may impose usage limits, storage limits, import limits, rate limits, analysis limits, or other technical limits to protect the Service, control costs, prevent abuse, or maintain performance.

Planned Paid Features and Waitlist

ChessForgePro may display planned Pro, Premium, or other paid access levels to show possible future features, limits, and pricing.

Planned paid access levels are provided for informational, feedback, and product-development purposes only. Unless a paid checkout is actually made available and You complete a purchase, displaying a planned plan does not create a paid subscription, purchase offer, reservation, guarantee, entitlement, or obligation to provide any specific feature, price, launch date, region, or payment method.

You may join a Waitlist to receive updates about planned Pro, Premium, or other future features. Joining a Waitlist is free and does not create a paid subscription.

Joining a Waitlist does not guarantee access to Pro, Premium, early access, discounts, lifetime access, special pricing, beta access, or availability in Your country or region.

If You join a Waitlist, We may contact You about the selected plan, launch updates, availability, and related product changes. You may opt out of Waitlist emails at any time by using an unsubscribe link where available or by contacting Us at chessforgepro@gmail.com.

We may change, delay, limit, rename, remove, or decide not to launch any planned paid feature, plan, price, limit, subscription model, or payment provider at any time.

If paid features become available in the future, additional payment, billing, cancellation, refund, regional availability, and consumer rights terms may apply before purchase.

Paid Features and Payments

At this time, paid features are not available for purchase through the Service.

If paid or premium features are introduced in the future, the applicable pricing, billing period, renewal terms, cancellation method, refund terms, payment provider, regional availability, and any required consumer information will be provided before any purchase.

Future paid features may be processed by third-party payment providers, merchant-of-record platforms, subscription platforms, or support platforms. Such providers may have their own terms, privacy policies, refund policies, billing rules, and customer support procedures.

We do not collect or store Your payment card details unless expressly stated otherwise in a future version of these Terms or in a payment-specific notice.

Nothing in these Terms limits any mandatory consumer rights that cannot be excluded under applicable law.

Voluntary Support

You may have the option to voluntarily support ChessForgePro through third-party platforms such as Patreon, Buy Me a Coffee, or similar services.

Voluntary support is separate from Your ChessForgePro Account unless expressly stated otherwise.

Supporting ChessForgePro through a third-party platform does not automatically grant Pro, Premium, paid access, increased limits, special features, or any other account benefit on ChessForgePro.

Payments, refunds, billing, cancellations, tax documents, platform account issues, and platform-related disputes are handled by the applicable third-party platform according to its own terms, policies, and procedures.

Unless expressly stated on the relevant third-party platform, voluntary support is intended to support the development of ChessForgePro and does not guarantee any specific feature, delivery date, roadmap item, service availability, chess improvement, account benefit, paid feature, or continued access to any part of the Service.

Voluntary support is not a charitable donation and does not automatically qualify for any tax deduction.

Third-Party Services

The Service may allow You to connect to or import data from third-party chess platforms such as Lichess.org, Chess.com, or other services.

We are not responsible for the content, accuracy, availability, policies, security, or functionality of third-party services.

Your use of third-party services is subject to their own terms, privacy policies, fair-play rules, API rules, and data-use restrictions.

ChessForgePro is not affiliated with, endorsed by, sponsored by, or officially connected to Lichess.org, Chess.com, or their respective owners. All third-party names, logos, and trademarks belong to their respective owners.

Account Deletion and Termination

You may delete Your Account at any time from the Settings page, where such functionality is available.

When You delete Your Account, Your Account and associated data will be deleted from Our active systems as described in Our Privacy Policy. This action cannot be undone.

We may suspend, restrict, or terminate Your access to the Service if You breach these Terms, misuse the Service, create security or legal risks, appear to be under 18 years of age, violate fair-play obligations, infringe rights, abuse resources, or if We are required to do so by law.

We may also suspend, restrict, or discontinue the Service or any part of it at any time.

Upon termination, Your right to access and use of the Service will cease immediately, except where We allow limited access for data export, account deletion, legal compliance, or support purposes.

No Guarantee of Results

The Service may provide chess analysis, engine evaluations, training tools, puzzles, recommendations, educational content, repertoire tools, and related features.

We do not guarantee any specific chess improvement, rating increase, tournament result, puzzle performance, opening knowledge, training outcome, or competitive result.

Your progress depends on many factors outside Our control, including Your training habits, skill level, tournament environment, opponents, time commitment, and other circumstances.

No Professional Advice

The Service is provided for informational, educational, training, and entertainment purposes only.

Nothing in the Service constitutes legal, financial, professional, tournament, federation, or official fair-play advice.

You are responsible for verifying whether Your use of the Service is permitted in any specific tournament, platform, club, school, or organization.

Security

We use reasonable technical and organizational measures designed to protect the Service and Your Account. However, no online service, storage system, or transmission method is completely secure.

Authentication cookies may be used to maintain login sessions. You should log out after using the Service on shared devices and contact Us promptly if You believe Your Account or session has been compromised.

You are responsible for using a strong password, keeping Your login credentials confidential, logging out on shared devices, and promptly notifying Us if You believe Your Account has been compromised.

Limitation of Liability

To the maximum extent permitted by applicable law, the total liability of ChessForgePro for any claims arising out of or relating to these Terms or the Service shall be limited to USD 100 or the amount You actually paid for the Service in the 12 months preceding the claim, whichever is greater.

To the maximum extent permitted by applicable law, ChessForgePro shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of business opportunities, loss of goodwill, service interruption, security incidents, chess losses, rating losses, tournament losses, or reliance on inaccurate analysis, even if advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise.

To the maximum extent permitted by applicable law, We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability, security, compatibility, and uninterrupted operation.

We do not guarantee that the Service will be uninterrupted, error-free, secure, available at any particular time or location, or that defects will be corrected.

We do not guarantee that analysis results, engine evaluations, recommendations, generated puzzles, imported data, training suggestions, or third-party integrations will always be accurate, complete, available, or suitable for Your needs.

Indemnification

To the extent permitted by applicable law, You agree to defend, indemnify, and hold harmless ChessForgePro from and against any claims, damages, liabilities, losses, costs, and expenses arising out of or related to:

• Your use or misuse of the Service;
• Your violation of these Terms;
• Your violation of fair-play rules, tournament rules, platform rules, or third-party terms;
• Your User Content or chess data;
• Your violation of any law or rights of any third party;
• Your unauthorized access to or use of another person's account or data.

Regional Availability

The Service is operated from Ukraine and may not be available, appropriate, or legally accessible in all countries or regions.

We may limit, suspend, or refuse access to the Service or certain features in any country, region, or jurisdiction where We believe that offering the Service may create legal, regulatory, sanctions, tax, payment, operational, security, or compliance risks.

You are responsible for ensuring that Your access to and use of the Service is lawful in Your country or region.

Electronic Communications

By using the Service or providing Your email address, You agree that We may send You Service-related communications, including security notices, account notices, important updates, waitlist updates, and administrative messages.

If We introduce optional marketing communications, We will provide an unsubscribe or opt-out method where required by law.

Changes to These Terms

We may update these Terms at any time. If changes are material, We will provide reasonable notice where possible, such as by updating the "Last updated" date, posting a notice on the Service, or contacting You by email.

Continued use of the Service after the updated Terms become effective means that You accept the updated Terms.

If You do not agree to the updated Terms, You must stop using the Service and may delete Your Account.

Governing Law and Dispute Resolution

These Terms shall be governed by the laws of Ukraine, without regard to conflict-of-law rules.

If You have a dispute, You agree to first contact Us at chessforgepro@gmail.com and attempt to resolve the dispute informally.

Any disputes that cannot be resolved informally shall be subject to the competent courts of Ukraine, unless applicable mandatory consumer protection laws require otherwise.

Nothing in this section deprives consumers of the protection of mandatory laws of their country of residence where such protection cannot be excluded by contract.

Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision.

Entire Agreement

These Terms, together with Our Privacy Policy and any additional terms that may apply to specific features, constitute the entire agreement between You and ChessForgePro regarding the Service.
